Terms and Conditions of Sale

These Terms and Conditions apply to orders placed through the Truffle Pig website. Truffle Pig is operated by TruffleHunter Ltd, a company incorporated in the United Kingdom under company number 06366331, with its registered office at Units C2–C5, Lakeside Business Park, South Cerney, GL7 5XL.

1. The Contract Between Us

When you submit an order through our website, this constitutes an offer to purchase the goods included in your order.

We will send you an email acknowledging that we have received your order. This acknowledgement does not constitute acceptance of your order.

Our acceptance of your order and the creation of a legally binding contract between us will take place when the goods are dispatched, subject to these Terms and Conditions.

Your contract will be with TruffleHunter Ltd, trading through the Truffle Pig brand.

Nothing in these Terms and Conditions affects any statutory rights that you may have under applicable law.

2. Prices and Delivery Charges

The prices payable for goods are those displayed on the Truffle Pig website at the time the order is placed, unless otherwise stated.

Applicable taxes will be calculated in accordance with the information displayed on our website and during checkout.

Delivery charges, where applicable, will be shown on our website and/or during checkout before your order is confirmed.

We may be unable to deliver to certain locations and reserve the right to restrict delivery areas.

3. Perishable Goods

Certain products, including fresh truffles, butter and other perishable goods, may deteriorate or expire rapidly.

You acknowledge that, due to the perishable nature of these products, cancellation rights that would otherwise apply may not be available once an order has been accepted or dispatched, where permitted by applicable law.

4. Cancellation by Us

We reserve the right to cancel an order or contract where:

• we have insufficient stock to fulfil your order;

• we are unable to deliver to your delivery address;

• one or more products have been listed at an incorrect price due to a typographical, technical or supplier pricing error;

• payment cannot be authorised or completed; or

• we reasonably believe the order has been placed fraudulently or in breach of these Terms and Conditions.

If we cancel your order after payment has been taken, we will notify you by email and refund the amount paid for the affected goods to your original payment method.

Where appropriate, we may offer you the opportunity to place an alternative order.

We will not be liable to provide additional compensation solely as a result of an order being cancelled.

5. Delivery

We will deliver the goods to the delivery address supplied by you when placing your order.

You are responsible for ensuring that the delivery details provided to us are complete and accurate.

Where international delivery is offered, you are responsible for complying with all applicable laws, customs requirements, import restrictions, duties, permits and regulations applying in the destination country.

We make no representation that all of our products may legally be imported into or exported to every country.

Delivery will be made as soon as reasonably possible following acceptance of your order and, where required by applicable law, within the relevant statutory delivery period.

Risk in the goods will pass to you when the goods are delivered or when delivery is made available to you, including where a courier attempts delivery at the delivery address on the scheduled delivery date.

From that point, the goods will be held at your risk and we will not be responsible for loss, deterioration or damage caused after risk has transferred.

If you request that a delivery be rescheduled, redirected or otherwise amended after dispatch, the risk of loss, damage or spoilage, including in relation to perishable goods, may pass to you from the originally scheduled delivery date.

6. Complaints, Damaged Goods and Liability

If the goods delivered to you:

• are not the goods you ordered;

• are damaged or defective;

• are delivered in an incorrect quantity; or

• have not arrived as expected,

you should notify us as soon as reasonably possible using the contact details shown on the Truffle Pig website.

Where a valid complaint is made, and subject to your statutory rights and applicable law, we may:

• make good any shortage or non-delivery;

• replace or repair damaged or defective goods where appropriate;

• reduce the purchase price by an appropriate amount; or

• provide a refund for the affected goods.

To the fullest extent permitted by law, TruffleHunter Ltd will not be liable for indirect or consequential losses arising from the supply of goods, including loss of profits, business, revenue or goodwill.

Nothing in these Terms and Conditions excludes or limits any liability which cannot legally be excluded or limited, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation.

Nothing in these Terms and Conditions is intended to limit any statutory rights that you may have under applicable law.

7. Notices and Communications

Unless otherwise stated in these Terms and Conditions, notices from you to us should be made in writing and sent using the email address or other contact details provided on our website.

Notices and communications from us relating to your order may be sent to the email address you provide when placing your order or registering for an account.

You are responsible for ensuring that the contact information associated with your account or order is accurate and kept up to date.

8. Events Beyond Our Reasonable Control

We will not be liable for a failure or delay in performing our obligations where the failure or delay results from events or circumstances beyond our reasonable control.

These may include, without limitation:

• strikes, lock-outs or other industrial disputes;

• transportation or courier disruption;

• breakdown of telecommunications, systems or network access;

• failure of suppliers or utility services;

• flood;

• fire;

• explosion;

• accident;

• severe weather;

• government action;

• epidemic or pandemic; or

• other events outside our reasonable control.

9. Copyright, Intellectual Property and Trademarks

Unless otherwise stated, the text, images, graphics, product photography, logos, trademarks, product descriptions and other content displayed on the Truffle Pig website are owned by or licensed to TruffleHunter Ltd or its affiliates.

Such content may not be copied, reproduced, republished, distributed, downloaded, broadcast, transmitted or commercially exploited without our prior written permission, except where permitted by law.

You are granted a limited, non-exclusive right to access and use our website for its intended purpose.

This right does not include permission to extract, reproduce or commercially use our product listings, product descriptions, photography, graphics, trademarks, metadata or other website content for your own business or for another trader.

10. Invalidity and Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision will be treated as removed or modified only to the extent necessary.

The remaining provisions will continue to remain valid and enforceable.

Your personal information will be handled in accordance with our Privacy Policy.

By using our website and placing an order, you acknowledge that you have had the opportunity to review our Privacy Policy.

12. Third-Party Rights

Except where expressly stated otherwise, a person who is not a party to a contract between you and us will not have any right under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision of that contract.

This does not affect any right or remedy of a third party that exists independently of that Act.

These Terms and Conditions and any contract between you and us will be governed by and interpreted in accordance with the laws of England and Wales.

The courts of England and Wales will have jurisdiction to resolve disputes arising in connection with these Terms and Conditions or the supply of goods, subject to any mandatory rights you may have under applicable law.

14. Entire Agreement

These Terms and Conditions, together with the information displayed on our website relating to:

• product prices;

• delivery terms and charges;

• contact information;

• our Privacy Policy; and

• any other terms expressly incorporated into your order,

constitute the agreement between you and us relating to the supply of the goods.

Nothing in this clause limits liability for fraud or fraudulent misrepresentation.
